Question: Is it legal under BHS Board policies, or acceptable to the Board, for the administration to submit a bid of this magnitude ($500,000 Livonia food service bid) that is binding upon the Board prior to obtaining formal approval by the Board? Isn’t the community entitled to have the board vigorously debate such new ventures before BHS makes a commitment? Assuming the submission of the bid is neither legal nor desirable, what does the Board intend to do?

Answer: The Board received notification that the District would pursue this bid on April 18. The Facilities, Finance and Legal Affairs committee reviewed the details at its May meeting, prior to the bid opening date. Had FFLA or Board members wished to withdraw, they could have done so. These processes were not illegal or in violation of BOE policy. In fact, this is exactly the process that the District used with the Avondale bus maintenance agreement that has been so successful for BHS.
